STANDARD TERMS & CONDITIONS OF CARRIAGE OF GOODS BY ROAD

TERMS AND CONDITIONS

1. Definitions
In these Terms and Conditions, the following words shall have the meanings assigned to them:

  • “Carrier” means Perazim Auto Transporters, including its employees, agents, and subcontractors.
  • “Consignor” means the owner of the vehicle or any person authorised to act on their behalf.
  • “Consignment” means the vehicle(s) being transported.
  • “Consignee” means the person authorised to receive the vehicle at delivery.

2. Ownership and Authority
The client warrants that they are the lawful owner of the vehicle or are duly authorised to arrange its transportation. The client guarantees that all information provided is true and correct.

3. Vehicle Handover
Vehicle keys must be handed to a Perazim Auto Transporters representative at the point of collection.

4. Payment Terms
Full payment is required to secure all bookings. Vehicles will not be accepted or scheduled without full payment.

5. Delivery Timeframes
Delivery will occur within the agreed timeframe after vehicle handover.
Working days are Monday to Friday (08:30 – 16:30), excluding weekends and public holidays.

6. Dealership Arrangements
The client must arrange dealership collection and provide full details. Vehicles left at dealerships remain at the client’s own risk.

7. Storage and Delays
A fee of R50 per day applies if a vehicle is delayed beyond 2 days due to no fault of the company. Storage charges may apply where delivery cannot be completed.

8. Insurance and Risk
All vehicles are transported entirely at the client’s own risk. The Company does not provide insurance cover for the following:

  • Electrical and mechanical defects or failures
  • Damage to the undercarriage or valence of the vehicle, particularly where the vehicle suspension is 150mm or lower
  • Stone chips, cracks, or any damage to the windscreen, glass surfaces, or body of the vehicle
  • Weather-related phenomena, including but not limited to hail, wind, flooding (rivers or dams overflowing), and other natural events (Acts of God)
  • Clients are strongly advised to ensure that their vehicles are adequately insured with their own insurance provider for the full duration of transportation.

9. Excluded Liability
The company shall not be liable for:

  • Mechanical or electrical failures
  • Undercarriage damage (vehicles lower than 150mm)
  • Stone chips, cracks and damage to windscreen, other glass surfaces or to the body of the vehicle
  • Weather-related damage (Acts of God)
  • Theft, hijacking or third-party incidents
  • Damage due to strikes, protests or unrest

10. Collection and Delivery
The client must provide authorised collection details. Vehicles will only be released upon valid identification. The company is not liable for incorrect delivery due to inaccurate details.

11. Personal Belongings
All personal items must be removed prior to transport. The company is not liable for loss or damage to personal items.

12. Accessibility
Deliveries will only occur where access is suitable.

13. Delays and Failed Collections
A fee of R100 per hour applies for delays caused by the client. Drivers will wait a maximum of 1 hour. If the vehicle is not ready, full charges still apply.

14. Depot Handling
Vehicles may be moved to a depot if delivery cannot be completed. Additional storage and transport charges will apply.

15. Route and Subcontracting
The company may use any route or subcontract services where necessary.

16. Valet Services
Valet services are conducted by licensed drivers. This service is uninsured.

17. Claims Process
Claims must be submitted in writing within 24 hours of delivery. Claims submitted after this period will not be accepted.

18. Limitation of Liability
Liability is limited as follows:

  • Total loss: Market value of the vehicle
  • Damage: Reasonable repair cost
  • Items: Replacement cost (if declared)

The company is not liable for the first R30,000 of any claim.

19. Storage After Completion
Vehicles will be stored for 7 days after completion. Storage fees apply thereafter.

20. Governing Law
These terms are governed by the laws of the Republic of South Africa.

21. Acceptance of Terms
By using our services, the client agrees to these Terms and Conditions.
